We breed with the love of the dog in mind. Every effort has been made to produce a litter both physically and mentally sound (“Puppy”). However, Buyer must accept full responsibility for proper care of this Puppy once he/she leaves Seller's home. The Buyer hereby agrees to maintain the Puppy in a healthy condition, which includes but not limited to a good diet, exercise and a clean and safe environment.
Buyer agrees to and understands the following conditions: The Puppy shall be kept as an inside pet and not kenneled or penned outdoors for long periods of time. Buyer agrees that if Buyer can no longer keep and care for the Puppy it shall be returned to Seller. Any refund to the Buyer will be at the discretion of Seller.
Consideration:
Buyer agrees to pay Seller the amounts and in the manner further specified in Schedule 1 attached hereto in compliance with the terms and conditions therein. A $100 application fee is required to be placed on wait list. Once puppies are born and the Puppy selection is made, a $500.00 non-refundable deposit will hold the Puppy of your choice until final payment is made. The total price of puppy is $2,800 which includes the application fee, deposit and sales tax. Due to the risks involved, the Seller will not ship the Puppy via airline cargo. If another means of transportation/shipping is agreed upon, the Buyer agrees to be responsible for any and all costs.
Restrictions
Buyer agrees that he/she shall not breed the Puppy and all breeding rights are retained by Seller. The Buyer agrees to spay/neuter the Puppy within twelve (12) months of the date of this Agreement, at his/her cost. The Buyer shall forward to the Seller a spay/neuter certificate from the veterinarian performing the procedure. If the Puppy is bred, intentionally or accidentally, Buyer agrees to pay a $15,000 fee to seller.
Representations and Warranties:
Seller represents and warrants that (i) the Puppy has had veterinary health checks at 8 weeks of age and has been deemed healthy, (ii) the puppy has been given age appropriate wormings and vaccines, and (iii) the Puppy is free of diseases at the time of transfer of the Puppy to Buyer. Buyer agrees to have the Puppy examined by a licensed veterinarian within (5) days of receipt of the Puppy. If Buyer does not have such examination conducted within the specified timeframe, the warranty contained in this paragraph shall be null and void.
Seller warrants, for two (2) years following the date of this Agreement (“Warranty Period”), to Buyer that the Puppy will be free of genetic/hereditary diseases. If the Puppy is found to have a hereditary/genetic disease by a licensed veterinarian within the Warranty Period, the Seller will refund an amount up to the purchase price of the Puppy. Prior to any such refund, Buyer must provide Seller documentation from a licensed veterinarian of the disease. The Puppy will be required to be examined by the Seller’s veterinarian prior to refund.
Limitations of Liability/Disclaimers:
Seller shall not be liable for any illnesses and/or injuries incurred or arising after the Puppy leaves Seller's home.
SELLER SHALL NOT BE LIABILE TO BUYER, OR ANY THIRD PARTY FOR ANY LOSS OF REVENUE OR ANTICIPATED PROFITS, OR FOR ANY INCIDENTAL, UNFORESEEN, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. THE FOREGOING IS A SEPARATE, ESSENTIAL TERM OF THIS AGREEMENT AND SHALL BE EFFECTIVE EVEN UPON THE FAILURE OF ANY REMEDY, EXCLUSIVE OR NOT.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT, FOR ANY AND ALL CLAIMS RELATED TO THIS AGREEMENT, SELLER’S CUMULATIVE AND AGGREGATE LIABILITY TO BUYER HEREUNDER SHALL IN NO EVENT EXCEED $2,800.00.
